Holman v. Commissioner (filed 4/7/10)

In this Eighth Circuit Court of Appeals case, the Court, in a split decision, affirmed the judgment of the Tax Court in a 2008 case. In our opinion, the Court misconstrued the definition of fair market value to make the other partners the “hypothetical buyers” whose intentions were irrelevant.
