Sabella v. Scantek Medical (filed 9/21/09)

In this U.S. District Court case, the Court held that a Daubert hearing was necessary before deciding whether an expert witness’ testimony was admissible. The expert witness had valued a public company by using the excess earnings method, which was challenged under FRE 702 as not generally accepted by the community of professionals to which the expert belonged.
