Thompson v. Commissioner
(decided 8/23/07 - Expert Qualifications)
In this U.S. Court of Appeals, Second Circuit, case, the Court questioned the
qualifications of the experts hired by the Estate in that they were from
Alaska and were valuing a New York publishing company. They had "demonstrated
no experience with....Internet- and technology-related companies" and were
"too inexperienced, accommodating, and biased in favor of the estate". On the
other hand, the Tax Court viewed the Commissioner's methodology as generally
deficient.
