This case involved the issue of whether
an appraiser’s prior appraisals
of the subject and other condemned
properties were properly admitted as
evidence. The Court held that
since the parties had the opportunity
to review non-Delaware case law
and present written and oral arguments
and that plaintiff failed to identify
any law or rule of evidence that would
bar the admission of plaintiff’s
expert’s prior and other appraisals,
the plaintiff’s motion to set aside
the commissioner’s award was denied.
